Business Litigation

LMM has achieved stellar results on both the plaintiff and defense side against some of the largest corporations and law firms in the country. LMM has decades of combined experience representing corporations and individuals in business disputes involving breach of contract, intellectual property, trade secrets, shareholder disputes, and real estate deals. Our clients work in a variety of industries and markets, including engineering, architectural design and construction management, oil and gas, real estate, and commercial manufacturing.

Our clients come to us for our no-nonsense approach to litigation and our ability to efficiently adapt our approach based on our clients’ needs and objectives. LMM’s experienced attorneys understand that litigation is often closely tied to the corporation’s business strategy and we are constantly looking for effective, practical solutions that directly address your unique goals. In many instances, we are able to keep our clients out of litigation by facilitating early resolutions or through other proactive means consistent with our clients’ aims. If resolution is not possible, LMM has the resources and reputation to deliver results at trial, and our track record reflects that fact.

Resolution of Dispute Over Mining Water Treatment Plant. Approximately six months before the scheduled arbitration date, LMM Partner Steve Litchfield was retained to parachute in as counsel for an ENR Top 5 AEC firm in a $150 million arbitration arising out of the design of a complex water treatment plant adjacent to a mining facility in New Mexico. On the eve of arbitration, Steve negotiated and structured a settlement that allowed his client to maintain its commercial relationship with the claimant—a multi-national oil and gas company—without paying anything on the claim.

Successful Resolution of Commercial Lease Dispute. LMM represented a national architecture firm in a dispute against its landlord in a high-rise building in Southern California. The landlord’s failure to maintain the premises caused a business interruption for the firm. After initiating arbitration proceedings on the client’s behalf, LMM Partner Steve Litchfield successfully resolved the matter with the landlord and shepherded the process through a coverage dispute under the firm’s business interruption policy, allowing the client to recover on multiple fronts to make itself whole.
